Ugghhh! I was helping a relative with a small business and as a controller and HR director for a fairly large company elsewhere - I figured I knew all the forms to send in. Well, I didn't know all the forms (we used sub-contracting payroll company and I never really knew the extent of the forms. I got the 941s. Etc in BUT NOT the W3 for 2008. I was trying to help this relative out while I had a full-time job and was caring form my mom who was an invalid. Today, we have a tax advocate helping with the business. I just did the books and my relative owned it; it was failing and by the grace of God I got it sold for him in 2010. We are trying to get some relief for all the penalties (not necessarily the taxes owed). Shld I just give a copy of the W3 that I've filled out now and not say anything? PLUS - I don't believe I have the right 'scannable form' only a copy I made years ago of the form from the internet. This is a terrible situation. Any ideas on what to do? Also, I was seriously crushed by unending work during that period (and sales started to plummet). My mother really, really needed my care and as it was - due to this business venture I really did not care for her as much as I would have liked. Does anyone see any relief for this situation?

You can get the scannable versions for Form W-3 from the IRS; you just need to call and ask for them to mail them to you.

Once you have submitted the needed forms, call the IRS and ask that they waive the penalties. You might be surprised how willing they are to waive such penalties, though interest MUST be paid as a matter of law.
