View Full Version : Summons for Child Custody, Child Support, and Payment of Lawyer Fees

I have been recently summoned to court about Child Custody and Child Support from my Girlfriends Lawyer. This hit me kind of out of the blue, we had been going through what I thought was a rough patch and when I got this in the Mail I was stunned. I would like to know the best way to respond. I haven't been a negligent father, nor have I withheld any funds from her, but the summons has wording in that makes me sound really bad, (its untrue). Should I go to Her Lawyers office to respond as my girlfriend suggests or should I get an attorney myself (Likely can't afford that). Suggestions?

You get your own attorney to handle your side of the case.

Your girlfriend is being smart by making sure custody and support are formalized by a court. This will be good for you as well. Attorney tend to try to make the other side look as bad as possible in their filings.

No, you do not contact her attorney. You cannot afford NOT to have an attorney if she has one, because the likelihood is you will get the short end of the deal. So you find your own attorney and show him (or her) the complaint and show proof that anything in the complaint is untrue.
