I was in marshall county mn and got pulled over by a tropper (for weaving in my own lane during a 44mph wind). I admitted to having drinks earlier. He said the breath tester was broken. So I had to do urine test, on the way to the station and at the station I asked to go to the bathroom many times because it had been many hours. He made me use the first void. It came back at .10. I was hoping to find some government studies or collge studies to prove first void is not valid bac. Thanks

You should have if I understand it, had the right to request and/or be given a blood test instead.

Next this is their accepted practice and it will take more than a few studies to get a judge to rule against state law. What you need is a very good attorney who can first try to find fault in the stop, in the procedure used, even question the fact that a blood test was not done.
Also try and get any statement you made thrown out.

At this point, hire an experience DUI attorney, they often cost 3000 to 5000 dollars but have a high success in getting people off.
