Fair to who?
Fair to the father in the US, no, since Japan should have honored the US law and handed the criminal back to the US and returned the child to her father.
Fair to society, no, it allows her to not be punished for her kidnapping of the child
To the child, it is not fair or unfair, she has the life she is now given. She is a US citizen by birth and has that right.
