Ok I filed my income tax and the state has decided to audit me. I file single because me and my husband were separated for three years. We just recently got back together and one of the questions they want to know if I'm married? Am I going to be on some kind of trouble and what are they going to do if they realize he don't have a social?

Most states require that you file your state tax using the same filing status as you used on your federal return, so if you filed as single on your federal return you may be OK. For federal it may have been possible for you to file as single as long as you could be "considered unmarried" even though you were legally married at the time. This typically applies to people like yourself who are separated. The fact that you later reconciled doesn't matter for years prior to getting back together.
