View Full Version : Tenant is 3 months behind in paying rent. She is in the US on a student visa

My tenant is almost 3 months behind in rent for my property in FL. I have worked with her in the past to rememdy prior situations, and every time she has paid current. This time is a different story. She is willingly vacating the property, (so I do not need to formally evict her) but she still owes me over $5,000 and "claims" will make good on her agreement. I have several emails from her stating this, but unsure of the collections process if she does not, as she does not have a US social security number. What recourse do I have in collecting past due funds from her seeing that she is not a US citizen. She is here from the UK on a student visa - she works full time & goes to school. Who would I contact to see if this is a VISA violation? ICE?
Any help is much appreciated.

I'd forget about reporting her to Immigration and sue her in Small Claims Court. You don't need a SS number to sue or be sued.

Collecting, of course, is another matter.

If she waits until she goes "home" you will NEVER get your money.

Why is she still there if she is 3 months late?

Maintaining contact with her is my concern-- once she is out (this weekend) tracking her down to get her served with a small claims case, may be impossible... Hence reporting her (or threatening to) may get her attention enough to cough up some money. I'm ust not sure of the exact route to take. I am just happy that she is leaving willingly and I do not have to go through the courts for that.
