View Full Version : Tax refund for stay lesser than 180 days in US on H1b, Still in US

HI All,

I came in US on 11th JUNE 2011. But then I went back to INDIA for a month on a vacation, which means that I have not completed the 180 days in US for the tax calculation of 2011. I am still in US.

I am on a H1b visa

I wanted to know... Will I get full tax refund or is there any disadvantage/loss of being in US for less than 180 days for last tax year (2011)

You are liable for taxes on salary earned while in the U.S. while on a H-1 B visa

If you are on a H-1B visa, that means you are being employerd by a U.S. company. Hence, your income is U.S.-sourced. If the income is U.S.-sourced froma "permanent base" in the U.S. it is irrelevant HOW LONG you are here. You ARE subject to income taxes (both federal and state) on that income.
