My algae eater is floating on top of water belly up and when I touch him he moves a little is it sick or dying?

I would say 'Yes' to both possibilities.

I just lost one a month ago, only it wasn't floating upside down but on the bottom, and moving after being touched. Take it out of the tank, and put it in a small container of aquarium water if you want to wait till it passes before you dispose of it.

I have two others who are doing fine, plus a dozen baby guppies as well.

I agree with Paleo, not a good sign at all.

If you have other fish in the tank that are all healthy, and all the water levels are normal then it's just bad luck I'm afraid.

There isn't much you can give in the way of medications unless there are outward signs of sickness (ie: white spot, finrot etc).
