My boyfriend has been out of prison for 6 years, he was in prison for 8 years for intent to distribute marijuana, and for carrying a firearm. He was offered a plea bargain if he was to rat out his friends but chose to take the whole sentence himself. We have been together for 2 years, he doesn't drink, do drugs, have a temper, everyone loves him. My question is that, I am divorced, with shared custody, when I was going through my divorce my ex knew of my boyfriends past and continued to tell me he was going to get custody from me because of it, well we went through the divorce and no custody battle happened, but a recent event, my ex-husband shoved me and my boyfriend then went over to tell him not to touch me, he did not threaten or harm him, but my ex-husband was granted a restraining order against him. I am asking if, based on he was a felon, can I lose the partial custody I have with my children? I am good mother, I have stayed home with my children for all of their 16 years, I have never worked outside the home, my ex-husband makes a lot of money and he HATES and DESPISES that I left his abusiveness and I am happy with someone else and did not go back to him and that he has to pay me a lot of money every month. He wants to make sure he punishes me for ever, and does not want to pay me for anything. I think that with this last ditch attempt at getting my children taken away from me, saying my boyfriend is a threat to the children. What do you think? Will I lose my children?

I don't think, if custody was not taken during the divorce that it would be taken now. If your ex does bring this to court, you will need to assemble character references for your boyfriend to show that he is not the same person who went to prison.

He can of course refile to change custody. Based on current anger and temper of boyfriend, if he can convince a court he is a threat to the children, or he is harming in front of the children ( mental abuse)

Your own description of him said "has temper" so even here instead of just saying nice things, you had to admit it.

So can he file, can he hire an attorney and make you fight him in, most likely yes.

I don't think he will win but you will have to get an attorney and the such if he files

Chuck, if you read the OP again she stated that he DOESN'T drink, do drugs OR have a temper.

Sorry OP, I did misread it, I thought it said he had a temper.
