View Full Version : Income Tax Mistake by Employer

When I got hired a year ago, I filled out all required tax papers, claiming no one. Now at the end of the year my boss tells me that the accountant for the company made a mistake and entered 4 dependents. Now she tells me I will have to pay the IRS for income received. I make minimum wage and she says I am going to owe 1,400.00. Is there anyway they can be held responsible for this mistake THEY made?

Not in this case. First, if you only make minimum wage you may have very little tax liability. I don't know how your employer can say how much you owe without doing a return for you.

Second, your employer can be held responsible for any underpayment penalty you may owe and should step up and pay that. But not the actual tax you may owe.

Third, many pay stubs list the W4 info so if you didn't catch it, at least part of the onus is on you.

So do your taxes and see how much you will owe. Maybe you can get your employer to pay to have it prepared or have their CPA prepare it. After that is determined you can then proceed. Maybe you can talk the employer to give you an interest free loan so you can pay it over time.
