View Full Version : Early termination from federal supervised release

I was sentenced to 18 months of prison and 3 years of supervised release. I have served 2 years of the SR and would like an early termination. My PO would oppose this because I still owe a significant restitution (about $9000 left) however I am homeless and underemployed and will no way pay this amount off before my term of supervision is over.
In my favor, I had an unusual circumstance occur just prior to my sentencing. BOP, while pre-calculating my sentence, decided to give me time served credit for time on an unrelated case and that before my sentencing, I had already exceeded my sentence. The time I did on that unrelated case was 17 months and the pretrial time for the current case was 14 months giving me 31 months on an 18 month sentence (by BOP's calculations).
My 18 month sentence was a binding agreement. Wouldn't the extended time be an unintentional breach of that agreement, and since I was a victim of that breach, wouldn't I be entitled to reparations of that breach?
