Can I sue her for alamony? For having her boyfriend at OUR house. After I had to move out. & we had an agreement that he wouldn't be there till after 3/16/12. Divorce date. & I know he's there a lot. A lot more than we agreed to... Can I have a restraing order placed against him till div. Is over?

Well that's kind of a touchy one.. Whose name is the house in? Yours. Both?

Look if her name is anywhere on that house, she has a right to say who can come and who can go... I just went through that... It sucks but it is what it is...

the house is in both of ours... but she told me her attorney drew up the papers to where I don't get 1/2. but we also filled bankruptcy. & owe 50g,s on home(9yrs) & we owe 50g,s(9yrs also) she said I got no bills... my truck.4wheeler.trailer.12x24 building & laptop. & no bills... but no half of house eather... I like the way that sounds... but we agreed she wouldn't have him there till after 3/16/12 div. date. I know he's there a lot. Can I file a restrainging order against him? & sue her for adultry?

She's even said she's slept with him before(since we've splitup). And what if I have pics of them together(posing2gether) before I ever got divorce papers?

What are you going to sue her for? It takes two to tango. No you can't sue another woman for having sex with your husband.

I don't know about where you're from but in Alabama you got to be separated for 6 months before you move on

Okay so you are the husband. Who do you want to sue? Your questions are cryptic and leave a lot to the imagination. You want to sue your ex wife? You want to sue the boyfriend? Please provide more information into this situation so we can help you appropriately.

If you were legally separated she free to be with whoever she wants. If she was having relations before the separation, then that would be grounds for the divorce.

You MIGHT be able to sue him for alienation of affections, but the chances of that are very slim.

I've merged your threads since they bear on the same issue. Please don't start multiple threads for the same issue.

If the agreement was in writing and the court is aware of it AND you can prove she has violated it, then you can use it to get a better settlement. Otherwise its unlikely to be binding.

Adultery is grounds for a divorce, not a suit. It could be a criminal act still on the books in some areas, but good luck getting a prosecutor to prosecute it.
