View Full Version : Is child abandonment an option?

I have two year old twin girls. Their biological father have never given them anything not financial or emotional support. He left when they were 6 months old. He had to be removed off the property where we stayed. He is an alcoholic and got drunk and broke the complex security gate. He does not call, does not write, there is no contact. I think we have heard from him about 3 times since he left. I do know he is in CA and me and the children live in GA. I don't want child support, he doesn't work anyway. I simply want him off the birth certificate and my kids to have my last name. He refuses to sign over rights. What should my next step be?

There is no next step. He cannot sign over rights unless it is to facilitate an adoption.. in this case by your husband. The birth certificate is a statement of fact. He is their legal father. That will not change unless there is another legal father, which will not happen unless there is an adoption.

Why have you not filed for child support?

I know that it would be wasted paper. He is not going to work. He will continue to live off his family. My boyfriend and I take care of the girls and have never needed him since he walked away almost two and a half years ago.

There is no "next step" you just can not do it.

In GA, merely not paying child support ( if any was ordered) and merely not visiting the child is not a reason to take away any rights.

One thing that sometimes work, you file for child support and force it hard, go after him hard and sometimes they will sign over rights
