I live in Boynton Beach Florida. I moved into my apartment in October. The first week I noticed the rats crawling and making noise in my wall. I notified them then. And every week after. So for the last 3 months. They have only put traps in my attic, but have done nothing else to resolve the issue. My neighbor downstairs from me has them in his home. And the other two units are vacant, which they may be infested as well. It is just a matter of time before they come into my unit. Is there a way to get out of my lease legally because of this? Should I get a lawyer? I need to make sure me and my 5 year old daughter are not in this environment. Since I have moved in, I have been woken up every night from this. And now my daughter can't even sleep in her room because of all the noise from them.

How do you know you are dealing with rats? How many times has the landlord/manager sent an exterminator to your building?

If you want to break the lease notify the landlord/manager IN WRITING that the problem MUST be resolved because it is dangerous to your health and safety. You can also report the uncorrected condition to the Department of Health. However - the landlord/manager must make reasonable attempts to solve the problem. Other than traps and poison I don't know what is considered reasonable in your City.
