View Full Version : Fathers rights to an unborn child who mother is moving away to another state

I recently found out that my ex is 4 weeks pregnant with what I'm 99% sure is my child. She is threatening to move to Maryland and keep the child there. What are my rights can I stop her from going? How am I supposed to see my child when he live halfway across the country. Is there anyway to make her come back after childbirth? Where would the jurisdiction lie for custody hearings? Ohh and she is claiming the child as mine. On a side note I'm not sure she's fit to even be a mother she's on soc. Sec. Due to many mental issues, has lived over 12 places in the last three years, has been in and out of institutions, and was removed from her fathers house after threatening to stab her family. Is this enough to get full custody?

Unfortunately you can do very little until the child is born. You MIGHT be able to get a restraining order preventing her from moving until paternity can be established. But that is a long shot and you should consult with a local attorney to determine the chances.
If she moves and the baby is born in MD, then MD will have jurisdiction for custody.

What state are you in? In some states you can file proactivly but nothing can be done until the child is born. It does give a foothold into the court system. But until further development that doesn't stop the mother from abortion nor anything else. Only orders can be created surrounding and after the birth.
