View Full Version : Rental Lease Void & I Want My $$ Back!

I am renting from a condo association, who received Order of Possession, by the court for my previous landlord. We've been in the unit for 2 years. We received papers from the Sheriff for eviction, and have attended the court hearing. The Judge stated that BOTH leases were void, due to the fact the association's order did not give permission to make lease agreements and that it only gave them permission to possess for only 13 months, thus we are being evicted in a month! I notified the association, and their response was "They let the attorney handle their proceedings, and knew nothing about it"-even thought during times notices were brought to their attention, we were harassed by them-and their lawyer- for rent, and were assured that the leases were valid, when they weren't. How can I get my money back?

You can not get money back for months you actually lived in the home, by making the lease void, it allows you to move without penalty. Without a lease, you are still on a month to month rental basis.

If they were asking for money for rental months after you moved out, this will void that debt.

While I don't think you stand a prayer of getting back the rent you paid while in the unit, there is an outside chance the judge might see it differently as punitive damages ignoring the law.

So consult an attorney and see if you can find one willing to bring suit. Of course, if you lose you will be responsible for the costs of the suit which will leave you in a bigger hole.
