View Full Version : Divorce before issuant of green card?

My husband and I have been married for 22yrs and we have lived in the USA for the past 11yrs. We have 2 boys, one in College and the other in High school. We have been in the green card process since 2006 and it's a long and exhaustive process. We originally came over on my husbands work visa H1 B which has now obviously been exhausted. We all have work permits and Advance parole documents to travel. Since the economy has tanked in the US, my husband has been working extensively outside of the US through his "american work based sponsor" Travelling back and forth every 4-5 months. Not the best of situations and unsure if this is in fact permissible? It's the only way to bring in an income and survive this nightmarish situation. It appears my husband my now have met someone else on his travels. I am not 100% certain of this but feel my assumption may not be far off. I don't think he wants to return to the US on his current travel document which expires in March.
If this indeed is the case, what is the legal position for the boys and I?
If he does not return, then we have no reason to be in the US since he will not be here and we don't have the Green cards?
All our current EAD's expire September 2012 and it was hoped that the Green cards would be issued before this expiration as this would be the 3rd time of renewing them, biometrics and $$$$?
It's a terrible predicament
