My divorce was finalized in March 2011 in the state of Colorado. Within the agreement, stated that my ex owed $450 in backed child support and $550 from a Motion to Compel that was granted by a judge in Jan2011. The motion to compel was to be paid within like 15 days in Jan 2011. He never paid, so that's why it was put into the divorce decree. The 450 and 550 was to be paid by May 1, 2011. After receiving no payment from him on 15May, I asked him for the money. His response was "I don't have the money right now but don't worry, you will get your money. I will have to pay in increments."
So from May to Sept I received $500 in money orders($100-once a month). Then in Oct the money orders stopped coming. I asked him about the money again. His response was "When you get the letter from my lawyer, you can call me and we can talk about it."
I received the letter from his lawyer a few days later, asking for things that weren't in the divorce decree. For instance the agreement said that he could call our daughter twice a week. His lawyer sent a letter saying he wants me to call or email him and give him updates on her weekly. He does not speak to me at all and if he does he is very uncivil. Things are his way or no way. I have major decision making and he has supervised visitation which he has yet to exercise. He is on probation for a Dui and a domestic violence charge. Is not paying a violation of his probation?
There is an "Indemnification" clause in the decree.What do I need to do to get my money?
I no longer live in Colorado, I'm Active duty and stationed in Arkansas. He still lives in Colorado.
