Yes, they are allowed to have cell phones.
And it's against the law to text "innocent people" (or, for that matter, guilty people) and harass them.
What's going on?

Me and my husband are being harassed by a guy that is in the witness protection program and are scared for our lives the local authorities say they cannot help us

Long story the cops told us that he is in witness protection plan he is harassing my husband through text messaging telling him that he will kill him if we don't give him what he wants he's really a sick person wanting me to do videos of me and another man performing sexual acts

Umm no cop should tell you that. But go to the Federal Marshall's office. They administer the program. Tell them you don't care who the guy is you just want him to stop.

How do I contact the feds my husband refuses to change his number he fears he will show up here and harm us he already has beaten my husband up he knows everything about us I'm sure he has mafia ties

I will add, sorry, no local police officer would or could ever know if someone is in the witness protection program, Even state police will not know, There is nothing in their new ID that will ever tell something.
Some officer was either lying to you or messing with you for some reason.
Only the Federal Marshal service ( and not all of them) will know who witness protection people are ( in the federal program)
So no this man is not in the witness protection program, because if he was and anyone knew, their life would be worthless, and marked for death,
If he was in the "mob" before, he is hiding from them and for him to do anything to bring attention would bring death to him.
If he told the officers that, he was just lying to them to sound big.
File a police report against him. If the police will not do anything, go to the DA.
But also just don't answer the phone if he calls.

One other point to add. The Marshalls, will not give you any information. They will neither confirm nor deny anything about this person. They will take your information and they will investigate. But you will probably not know if any action is taken except maybe the guy will stop calling.

We tried telling the cops that he is harassing us the da won't do anything about it I don't know its frustrating that they won't help us but I will contact the federal marshalls and try to get it to stop he doesn't call us he texts my husband and threatens him with everything from killing him to taking our kids

I'm very surprised that nothing is being done. If you have texts that show threats, the police or DA should help. I would go up the line with your local police or DA and demand that action be taken. If you are still not getting anything, go to the media and tell them you are being ignored by the police.

But, I promise you, this guy ISN'T in that program.. The cops LIED to you. Think about it. If the guy was REALLY in witness protection, the cop wouldn't know it.

I agree with excon, so the question now becomes WHY did the police officer lie to you? I think you need, as I suggested, take this up the line. Something doesn't sound right.

Excon beat me to it! There's no master list of people whose identity has been changed. Take the text messages to the Police, leave out the part about the Witness Protection Program, let them move on the threats.

I agree, I worked for the program indirectly in a job training program. In our facility I was the director. I was the only person who knew which people were in the program and which were not. I did not know their real names, and they were given new names the second they left my program.
There is no one outside the Federal Program that knows who these people are. A police officer who may have found out, would or could be fired for telling anyone.
Next people in the program can be arrested, there is no protection of them from being charged with new crimes.
You need to take recordings of this to the police and the DA, if they don't do anything, go to the newspapers about the police not doing their job.

I don't know how to find out his last name the federal marshalls told me to go to the state police or at least find out if he is involved in a federal issue that's the only way they can help us

That we can't answer. Clearly he is someone who knows you or is having you investigated. We have no clue why you are being targeted. But you NEED to push the police on this. Or hire your own PI to try and track him down.

This guy is slick the federall marshalls won't do anything for us they will protect him cause he's their witness how messed up is that we as law abiding citizens get screwed so much for justice in the usa

If he is not in the program the federal marshall will not do anything either, Even if they do something, they would never tell you. Investigating anyone's threat against YOU is not their job.
If the local city police will not do anything, go to the sheriff ofice.

Beat me to it - most people making harassing phone calls don't ID themselves as members of the Federal Protection Program. I'll bet NONE of them do, in fact.

Sometimes we have to WORK for justice. It doesn't just HAPPEN. You asked how to contact the feds and we told you... We also told you the feds won't DO anything.
Your problem STARTS and ENDS with the lying cop. THAT is where you'll find justice IF you're going to find it at all. I don't know WHY he lied to you. I don't know WHY you say the DA won't help you.. But, I'll bet you didn't GO to he DA's office to hear that directly from HIM. I'll bet you took that LYING cops word.. I'll also bet you didn't go see that LYING cops SUPERVISOR. I'll also bet you didn't go to the press like Scott suggested you do...
So, if you're willing to go out there and GET your justice, it's available... But, if you expect it fall in your lap, you'll get what you got.
