View Full Version : Can my 21 yr. Old take me to court for child support?

My daughter will be 21 in march and lives in NY and I live in NC ,she has been married for almost 3 years but doesn't live with her husband for at lease the past 2 years.She has moved in and out of my house for the last 4 years about 40 times.She receives SSI and now she wants to to make to court for child support.I do not work and I'm waiting on my Disability hearing.Is this possible for her to do?

She is very unlikely to be successful. Child support, if ordered, is payable to the custodial parent, not the child. If the custodial parent does not sue you for it, that is the custodial parent's decision. The child can not.

She is receiving SSI and only pays 146.00 a month for rent and utilities .Does she have the right to do this?

First its not a good idea to piggyback your question on someone else's. This can lead to confusion. You should start a new thread. So I've moved your question to its own thread.

Since you posted this under an old thread about support after 18 we are assuming your daughter is trying get support from her father. Did you ever apply for support from him? Was a support order ever issued?

I see you posted another question so I merged the threads. Its still unclear whether you were the custodial parent or not or whether support was ordered.
