View Full Version : Restraining order against roommate?

I am in the process of having a restraining order against my roommate. She had assaulted me the week before twice and twice I called the police. I was advised by the officers that came to the scene to go down to the magistrate's office with the report numbers. I did that today since I couldn't do anything because of the holidays. I was told she will be served to show up to court. I am not sure if a restraining order will be issued, but if it is issued, and she is ordered to stay away from me, will that mean she would have to move?

Yes, if the restraining order is granted, then she can't come near you. She will have to arrange, through the police for a time to pick up her belongings.

Okay, I know every state is different. Would that be true for the state of virginia?

Yes a restraining order requires she stay away.

Now of course if you are room mates, is there a lease, are you able to pay the landlord the full amount of rent?
