View Full Version : Can I move my child out of Texas?

My ex-husband and I were married twice and divorced twice. During the divorces, one child was involved, we have joint custody. The papers state I can move over 100 miles and have visitation agreements in those papers set up for such an event. Since the last divorce in 2006, we had another child in 2008, and are currently not married. Can I legally move my newest child out of state without any consent or agreement?

No, you will need to have a child custody paper work like the other filed and approved by the courts.

So basically then, I just go to the child support division and file for child support and visitation? Thank you so much for such a fast response!

And then file for a child custody agreement.

You probably have to go back to the court that issued the divorce decree for modifications of the agreements. You definitely can't just move without court permission.

I don't know the laws of your State.. but.. is he named as the father on the birth certificate ? (is he the legal father)?

If he is not the legal father - then you can do what you want (still don't know the law of your State).

You would need to know what the law of your State says about taking a child out of State.

In my State, your choice of where you live is not only a personal issue between you and your child. It is also very much a legal issue.

IF.. he is the father, it would be best to make it ALL legal... especially, after your 1st divorce was specific about it.. it could be legally implied that you knew better.

Better to be legally safe than sorry.. go to Court - get it in writing.. and make it legal (when you do, always have your papers ready for show).
