View Full Version : I live in Va and my son will not let me see my grandson?

My husband and I live in VA as does our 7 year old grandson and his father, our son, and his mother. Our son and our grandsons mother were never married. Our son has now married. They have joint custody, 4 days one week 3 days the next. Our son lived with us the first 4 years of our grandsons life. Now that he has married they will not let us see our grandson. We live about 40 minutes away from them. It breaks our hearts. We have a good relationship with our grandsons mother and she will let us see him about once a month when possible. We do not feel we should be taking her and her family's time with him. Our son and wife should be sharing their time with us. My son and his wife lived together before they got married. While they were living together we got to see our grandson every weekend, as soon as they got married that stopped. What can we do?

The first thing to do is find out why you were cut off.

The good news is that VA law does recognize you have rights as a "person of legitimate interest." Given the relationship you have established with your grandson, I believe a court will allow you some visitation. But going to court over this should be a last resort.

I would invite your son and his wife to a holiday dinner. This is a good time for that. At this dinner you should talk with both your son and his wife and determine why they have cut you off and what you can do to restablish your relationship.
