View Full Version : Help with middle Tennessee laws on being a tenant on a lease

My ex girlfriend told me I could take over the lease and she would sign off all of a sudden she changes her mind after I have put 1500 into this house and is telling me I have 5 days to move because she is moving back in if I am not mistaken she cannot do that I have to have an eviction from my landlord she gave her thirty day notice and then 2 weeks later changed her mind and now this is where I am at my name has been on the lease since may 2011 the lease ends on the 13th day of may in the year 2012 what can I do I have no where to go I will literally be living on the streets I need help fast she told me last night I had 5 days

You said your name is on the lease. Are you listed as a tenant or an occupant?

If you are listed as a tenant then your ex can't kick you out at all. You have the same right to be there as she does until the end of the lease.

If you are listed as an occupant then your ex would have to give you a written notice that your tenancy is terminated and give you 30 days to move out. So don't worry about the 5 day nonsense.

But let us know the exact wording in the lease as to how it pertains to you and we can give you a better answer.

Agree, how is your name on the lease. Did she and the landllord agree that she would be allowed to move out. She gave her notice to the landlord ?

Have you spoken to the landlord as to who is the tenant or not ?

Its exact wording is lessee under both of our signatures

You signed the lease and it says "lessee"? That would make you a tenant and not just an occupant. That would mean that you have the same right to live there as your ex and she can't kick you out.

The only way I could see her having the right to kick you out is if she had obtained a restraining order against you.

She cannot evict the OP. In fact, if I were him, I would be worried about whether she will continue to pay her portion of the rent. If she doesn't, the LL could kick both of you out.

You signed the lease as a tenant and you pay all of the rent? I wonder what made her think that she could give you 5 days to get out? Don't bother packing. You don't have to go anywhere.
