View Full Version : 17 year old refusing to live with custodial parent

My 17 year old son wants to live with me(non custodial parent) My ex husband and I have a parenting plan that was written when he was 11 it is from the state of Washington I now reside in Oregon and his father is in Idaho. My question is after my visitation if my son is refusing to live with his dad will he be forced to? I know I can do a modification of the parenting plan however this seems like a lot of money and time when he is 17

Yes, he can be forced. As long as there is a court order giving the father primary custody, if he doesn't return, you could be held in contempt of court.

How soon before he turns 18. Have you tried talking to the father?

If is not as much as he is "forced" as you are ordered, and can be charged with interference with custody, ( criminal charge) and also contempt of court by the family court.

So after they arrest you, he is picked up by children's service and returned to his father.

It is up to the dad to agree to allow him to stay.
