View Full Version : Child Support after 18 years of age

My nephew has never really keep up with his child support payments. He was not quite 18 when the girl that he was seeing got pregnant. He left to Denver and has not be back since. Now after almost 18 years and he being in/out of jail wants to get back on track with his child and start paying. So I live here in CA and started looking up his paperwork. Well in the search I asked him why he didn't pay and he said that he didn't think the child was his because this girl was seening another guy. I didn't know this and then I started asking more questions. It turns out she got pregnant when he was in Denver. Well since I was not around back then he because the default dad and even if he proves he is not daddy, he will still have to pay child support.
The question I have now is that he is schedule to have a phone court hearing on his child support. I find that odd since the child support people have had all his info and have already been to court on this. I just wondering if this might have sometime to do with the child turning 18.

Only he can tell you why there is a hearing. Or he may just be talking to the child support caseworker. If it is out of California then he will owe 10% interest compounded on any back child support if there was an order in place.

He may end up paying for the rest of his life. Keep us posted.

Yes he will. A few years back the state of CA had given default dads a second chance to prove parnity pass the 2 year time limit, however Child Support Svs didn't inform any fathers. It turns out that a lot of women living around military bases; especailly in San Diego, were using military men that had been shipped overseas. At returning they were hit with this defualt dad and had no way out pass the 2 year time limit. So many women were getting child support and living with the actuall dad of the child. Now a new law gives men more time. There is a lot of men going through this right now here in CA. Thanks for your answer.
