Hello. I live in Los Angeles, CA and I have a situation. I have 2 people living with me and have been causing me problems for the past month. I gave them notice the week after they moved in because the roommate and I kept clashing everyday. Now what is going on... it's almost time for them to leave. Last night he said that we they were going to leave and move into their new place but he said he will come get their stuff in a few days. Is this considered voluntary leave? In that case am I to give them back any of the rent and are they to give up the key and clicker? I told them they had to be out by December 11th by 11:59pm and to give my key and garage clicker back. Also, they are not on my lease at all and the only thing that was documented stating that they are were staying here was a early deposit of $100 like a week before they moved in. I told them they were to pay $250 for rent. I received the rest a few days after they moved in. What am I able to do?

How much do you want to fight them? If you don't feel like a fight refund a portion of their rent.

If you do feel like a fight, don't and see if they take you to Small Claims Court.

If you TOLD them to leave and that's why they are leaving I believe it's a form of constructive eviction and you owe them.

As long as they have access to the property they are tenants. See what they do about that.

Storing their belongings? I'd give them a specific number of days IN WRITING within which to pick up their "stuff." After that you will put it in storage at their expense or dispose of it.

You could be watching their stuff for them for the next year if they aren't put on notice.

You gave them until the 11th to leave. Was this in writing?

Tell them, if their things are not out by the 11th then you will have them put inn storage at their expense. And that you will be changing the locks on the 12th.
