View Full Version : Could we lose custody to a ex con drug addicted mother?

My husband has three children from a previous marriage, he has been their primary caregiver their whole lifes. He has full custody of them with his ex having no visitation of any kind. She has only seen them a few times in the last almost 5 years. They hardly know her and have no relationship with her. She is recently out of prison having done time for a violent theft and selling drugs. She has been harassing us with threatening phone calls until we just stopped answering. She is wanting us to give her joint custody or she says she will fight for full custody. We found out recently that she got pregnant right out ofprison and then overdosed while pregnant. We have paid a sizeable retainer to a very good custody lawyer in case this goes to court. So far she has not filed anything but I am stressed and worried, I can not imagine having to hand these children to her even for visitation. So I guess my question is what are her chances of getting any type of custody? And if visitation is ordered can we request supervised as well as continued drug tests. Thank you for your time.

If a court awarded full custody with no visitation to your husband, then she would have to prove she is completely rehabilitated to get that order changed. I don't see that happening in the near future. She would probably have to be clean and out of trouble for at least a year before a court would even consider supervised visits.
