No this is a CRIMINAL matter and needs to be dealt with through the proper channels.

Call the police non-emergency number and ask to speak to a woman detective. That's the first step.
The police will talk to the DA about the possibility of a criminal charge, depending on how much evidence there is at this time (you don't say how long it's been or if you have witnesses).
You can sue in civil court, but need a lawyer or you will probably lose. The detective may know of legal aid law firms or ones who do some pro bono (no fee) cases.

You can sue, but if you don't pursue a criminal case, I doubt if you will win.

Even if you don't win the criminal, you need to follow up and file charges, Beyond that, you need an attorney to do any law suit for damages.
