My brother was recently released from jail and is currently living rent free in my and my mother's apartment. My mother is buying a home and when we move, he will be coming with us. We would like to have some sort of contract with him stating that he has to be bringing in some kind of income in x amount of time, cannot do illegal drugs, alcohol, or illegal activities while living under my mother's roof. We also want to be able to require randomised drug tests and random inspections of his sleeping area (it will not be a room of his own, he will be sleeping in the family room on his mattress) for illegal things. We want to be able to evict him from the premises with as little notice as legally possible. We are giving him a chance, but we need to be smart about this because he is a convicted criminal and has plenty of past history.

I don't know if it would be a lease agreement, because he will not be paying rent, but we're just totally confused about what exactly to have him sign. This is also never meant to be a permanent living situation, so we want it to be a month-to-month contract.

Help! I'm so lost!

So write it up, tell him to sign it or get out.
