I have a friend that wanted me to ask you something since you were helpful with me. She got pregnant an than married to the man she believes is the father of her child an he does also than she had her son. If another guy wanted to get a dna test done an thinks he is the dad how easily would if be for him to get it done? And if he was the father but was consider an unstable person or parent would he be able to get custody rights?

Isn't this the SAME question you asked and received several answers to? Here's your question:

I have an amazing little girl and an wonderful boyfriend! When I got pregnant the what I call sperm donor said he hoped she died an he didn't want to have to pay child support. He was really bad into drugs still is from what I'm told. Well I meet an amazing guy who I had been dating when I found out I was pregnant. When she was born he signed the birth certificate an the paternity paper as well. But now that she's a month old her sperm donors parents are wanting to see her an let the sperm donor be involved. Is there any way they could get a DNA test from the court if she already has a dad on birth certificate an on the paternity papers? I haven't been contacted by sperm donor since day I told him I was pregnant only been contacted by his mom one time after I had my little girl.

The answer is the same. If someone has been declared the legal father and they are not the bio father, the bio father can go to court to get a paternity test and contest paternity.

How much time and under what conditions the bio father has to file this challenge depends on local laws. But the possibility is there.

i wasnt able to respond back to question on there but what if the father on the birth certificate thinks hes the father an was told he is the father. an dont want a dna test done can the other guy still get a dna test. Are you saying anyone can just claim someone as there child an get a dna test done without permission of the childs parents?

I don't know why you couldn't respond, but I'm answering here. Again this is subject to local laws and you haven't given us that info.

Almost all states provide for challenges to paternity. But yes anyone who believe they might be the father may be able to mount a challenge. Before a court will order a test, though, the petitioner will have to show there is a possibility that he might be.
