I was sentenced to served 24 months and 1 day in federal prison plus 3 years of supervised released. In my case, however, since I am not a U.S. citizen, I spent 10 months after my prison release date(12/23/2010) detained by the immigration authorities. My question is, if based on that extra 10 months in incarceration I spent (which could be considered more than "probation" since I was actually deprived of my freedom), could I ask the judge to terminate my probation on the first anniversary of my release from prison (12/23/2011)?

Hello a:

Sure you can. Write him a certified letter telling him WHY he should do it, and send a copy to the prosecutor and your PO.

If you think about it, he has NOTHING to gain, and everything to lose by doing it. So, I don't think he'll do it, but you certainly can try.
