View Full Version : Possible Violation of Privacy act and HIPAA

My ex boyfriend is suing me in civil court for anything and everything he bought me while we were together, but he is acting as his own laywer and submitted documents of my life insurance appliacation that has medical information on it, and my resume from me submitting my resume to get hired at his insurance agency 2 years ago. The life insurance application was taken on a policy I have with his company. Does this violate the privacy act or HIPAA?

If he got it from his insurance company without a court order yes, If he had a copy of it, because you lived together and he just had a copy from that time, then no.

Not sure why all of that is evidence, sounds like you need an attorney to throw out all of the BS he is submitting as evidence.

He did get it from his insurance company files without a court order, (he works as a financial rep at allstate), we did not live together. He bought me expensive gifts, designer clothes, shoes, and furniture that he doesn't want back but feels he is entitled to use every legal avenue he can go down to drive me crazy, I've been served twice in front of my kids, and since I would not agree to giving us another chance I get letters for addmissions left and right. I make sure that I answer them left and right and looking for an attorney as we speak... thanks

No this has nothing to do with HIPAA. HIPAA protects you from your medical provider revealing info about you wihtout your permission.

Since the info was obtained from your employer and not your medical provider, no HIPPA violation.

However, if he obtained the documents from your employer without permission, then he may have violated rules established by Allstate.

The life insurance application that he submitted had medical information on it and personal information, and I don't work for Allstate, he does. While we were dating I took out a Life Insurance policy through Allstate, he was the Life Insurance agent. I am still the owner of this policy as well.

Ok, then he had the paperwork as part of your purchase of a policy. So you volunteered the info. Definitely no HIPAA violation. But I don't see how the info pertains to his suit.
