View Full Version : Child Support Unit Not Making Proper Payments and Pay Less Than What Was Ordered

I should be receiving more than I am getting for child support. The child support unit said that what the father was ordered to pay was too much and they are not allowed to take that much out of the father's pay check every other week. So now I get less than I should be for 2 children because the child support unit took it upon themselves to disregard a court order. The support unit then takes the money out of the father's pay check every other week in the full amount but they can't seem to deposit the full amount into the children's account. They deposit whatever they feel like and then put the rest in before or on the day the next payment is suppose to go into the account. There should be a little less than four hundred put into the account every other week and some weeks they will put in eight dollars and then the rest won't go into the account until the next payment is due. So can anyone out there tell me if this is right or even legal. When I call the support unit about it they try to get me to take the father back to court or give me the run around about some account. I want to know who is lining their pockets with the children's money. They take it out of his check in full and should be able to place it in their account in full. Why should my children suffer because the state does not know how to spend money properly. What is going on wthe the child support unit in Greene County in New York State? Why are they not taking out what court orders tell them to take out and why can't they deposit the full amount into the account?

Go to the local prosecutor and report this. It is possible that the amount ordered by the court is more than they can legally garnish from his salary. But if that is true, then they can't deduct the whole amount.
Some state agencies do take a portion for processing fees, but that should be stated.

They sent me a letter stating they couldn't garnish that amount from his salary. I was not sure if that was legal or even correct. I mean wouldn't the court know it would be too much to garnish before they ordered a set amount? That just seems crazy dumb to me. Anyway, they take the 399 from his pay every other week like they should be but they don't put the full amount into the account. So the father gets paid on Thursday and the child support unit takes the 399 from his pay check on Wednesday. The child support unit then is suppose to do a direct deposit into the children's account the following week and most of the time they do but it's never in the full amount of 399. Some weeks they will put 8 in and then the following week or the week the support is due again they will put the rest of it in the account. You see my issue? I am a single mom of 2 and I don't make much money and my children have health issues. The both have asthma, and my son has high blood pressure already. These medications are not cheap even with health insurance. I don't want to take the father back to court for more money, I just want them to put the full amount in the account like they take it out of his pay check. Can the child support unit not handle that? And why are they pushing mothers to take the fathers back to court for more money? It's like they don't hear what I am saying to them. How can I make them understand me?

I told you how. You go to the local prosecutor's office and file a complain. If something illegal is being done, then action will be taken. If its not illegal you should get an explanation.
We understand why you are angry and confused. Based on what you said in the first post, I would be too. So you need to take the action suggested. Just posting more of the same is not going to get anything done.
