I let my parents have custody of my 8 yr old son when he was almost 4. They are now keeping him from me. I received a felony back in 07 and did 15 months in prison. Been clean from 07-now. Can they keep him from me legally? Have my own nice two bedroom house and lifes been great for me. Everything but what my parents are doing with my son anyway! I am soon going to mediation and want my son on the weekends. Is that possible they can keep him from me? Even when I gave custody over my own self back then and can I get it back?

It depends on the conditions under which the got custody. Generally, unless they adopted your child, you should retain some level of custody. If you can prove to the court that you are not a danger to your child. You may get some visitation.

It was out of my kindness when my mom asked me if I would give them custody. That was for a while until I got better with life! Never involved with DCFC or anything.

No court order of any kind? We really need more details.

Nope no court order at all. I went with her and had some papers drawn up and that's it. I went to high school with the attorny and he will not help me nor my parents now!

It doesn't look like they can legally do that.

If he drew up the papers you signed earlier, it may be unclear whether he represented you or your parents. If so, he can't help you now because he would possibly have a conflict of interest.

Just depends on what those papers were and if they were filed in court and signed by the judge.

You need to get copies of those papers and see what really happened.

I agree that this all hinges on what is in those papers and what was done with them. Without knowing we can't advise what your next step is or what your chances are.
