I have a 1 year old son and his biological father has never seen him and is not listed on his birth certificate. I have tried to contact him and even tried to get a DNA test done so he could be a part of his sons life but he did not show up.So evidently he dose not want to be a part of his sons life. My husband has been there since my son was 3 months old and would like to adopt him. How could we do that? His biological father will not talk to me so I have no way of asking him to sign over his rights and a DNA test would have to be done first and he will not show up to take one. Please help. Thank you.

Yes, that's do-able. Here (https://www.askmehelpdesk.com/family-law/stepparent-adoption-indiana-145916.html) is another thread in this forum where another Indiana step-parent adoption was discussed. While we strongly recommend that you get a lawyer to do the adoption right, there are do-it-yourself forms (http://family.findlaw.com/adoption/adoption-resources/state-adoption-forms(2).html) available online.

Apparently you have been married for about nine months. I don't know off-hand about Indiana, but some states require that the step-father who would adopt your child has been married to you for at least a year.
