I have an 8 year old daughter of which her father recently started to see and pay child support. He as paid approximately 200.00 a month for about 7 months. Prior to that he was no where to be found. Now he's almost demanding visitation every other weekend and alternate holidays. My question is because he now gives child support does does he have to get visitation every other weekend. There's no court order at all.

You need a Court Order. You appear to be accepting far too little child support AND there is no connection between support and visitation. YOU control the child; YOU control the visitation.

Keep in mind that if he takes the child and does not bring her back you will have to go to Court and try to get the child returned to you IF he is the acknowledged father.

First every other weekend and every other holiday ( plus one day during the week in the evening is almost standard, unless he is a threat to the chlid, that is about the less ( min) he would get. Most likely he could get even more if he asked for more in the court.

Also if there is no court orders at all, he does not even owe you a penny child support.

Next child support and visits are not connected, he could be behind 30,000 dollars in support and still get visits though the court.

So you and he need to set down, get to court and get the custody of the chlld, the visitation of the chlid and the child support all set by court order.

But yes, if he has started visits, and is only asking for about the min amount of time, the court if he went to court, may think negative of you for not allowing that little amount of time

No without a court order he can demand nothing,I would let him take me to court for visiting rights and I think the judge may order his child support payment to go up seems to me he is not paying nearly enough,not to be mean to him but as you know the cost of raising a child today your husbands support is to help pay for all things your child needs clothes food after school events dance lessons or sports activities and even the neighbour hood she grows up in so until he gets a court order he has no right to demand anything I hope you can get a court date soon because every child needs both parents in their lives but then again only if they are doing right by the child.

Actually, if there is no court order in place, he would not be obligated to bring the child back. In the absence of a court order, both parents share full custody rights.

That's what I meant - if there is no Court Order and he takes the child with her permission and doesn't bring the child back as promised she has no legal recourse other than to go to Court and try to get the child back.

I realize they have equal rights if he's the proven father but there are no Orders.
