Dear all,

I have H1B since I entered in US (8/2006) and my wife and daughter have H4 since the same date.

Filling the 1040NR I will not be able to include my wife and daughter. Is there any possibility to include then (for instance, wait until may when I will be a resident alien)?

Thank you,
Gustavo.

Gustavo:

You can file jointly with your wife and CHOOSE to be treated as resident aliens for all of 2006. However, this means that ALL of your 2006 world-wide income is subject to U.S. income taxes. It MAY not be worth it.

Otherwise, you must file as a non-resident alien.

What country are you from? You MAY be allowed to claim your wife and daughter as dependents if you come froma certain country.

Thank you for your attention, I appreciate that!

We are from Brazil, both do not meet the SPT, should I wait until I meet the SPT?
I am going to meet the SPT in the end of April.

Thank you again,
Gustavo.

Actually, you will not qualify for SPT until after May. Read chapter 1 of IRS Pub 519 to see how SPT is calculated over two years.
