View Full Version : Tenant vs. Tenant issues?

I have resided here for the past 8-9 years in the same building/house. For 7-8 years I resided in the basement apartment,an opportunity came up for me to get the apartment above me which has many windows, is above ground, as well it also has a little side porch and 2 lovely windows in the kitchen through which I can get daylight through out the entire day! I was excited when I got this apartment because I suffer from being clinicalely cronic depression and residing in that basement apartment for the past 7-8 years has been especially difficult on my health, not to mention that I suffer from fibromialgia, arthritus in the spin, as well as borderline personality disorder, all of which befinfits being in an above ground apartment which provides plenty of daylight.
When I first moved in the basement apartment there were people who resided in an apartment which had to be accessed by the fire escape stairs which just happened to pass right by my bedroom window at the time when I resided in the basement.They would do everything possible to ruin my enjoyment of life (as miserable as I may have found it at the time) they would have their kids place their bicycles right up against the awning that was just over my window(to keep snow out in the winter time)and block any daylight I might get as the window was quite small. Now, please understand, the landlord was the best you could possibly ask for in these times, and finding another apartment was impossible, I know this because I tried throughout the 7-8 years I lived there, believe me. Anyway, these other tenants would pile their garbage right beside my bedroom window, and make certain that when garbage day/night came aroound that whatever garbage they had kept upstairs came tumbling down the fire escape stairs as early or late, depending on the time of pick up , well, without going on and on I am sure you can understand the circumstances I had to live under with them as neightbors.

Well, you can imagine how pleased I was to hear that they were moving right out of the building! About a year or so went by and living in that basement apartment became almost bareable. Until, THEY moved back into the same apartment.Well, within this past year, I made the move into this apartment that I am now in , which is in the same building with the same great landlord.However the tormenting has started up again, starting with bbqing right under(right beside, may as well have been right under) my kitchen window. I would always know when they were bbqing because my kitchen would get smoked out.
Now, I must tell you that not only am I not a person who can handle confrontation very well but I also have a severe "nerve" problem, by which I mean, someone wants to confront me /start trouble with me, my nerves start going and I start to shake like a leaf in the wind & my legs turn to complete jello(I got picked on and beaten up a lot at school) . Back to the BBQ, I asked mylandlord to speak with them but he claimed to be so busy that he didn't have the chance to get aroound to it, so I called the local fire department and asked what the law was concerning the distance between a residential window & a BBQ being in use. I was told it was to be 10 feet, I explained my delema to the fireman I was speaking with and he said he was on his way out and would drop by and have a talk with the neighbors. Well, he told them and the neighbors after using the bbq they would remove the propane tank and then they would just hook it back up when they wanted to use it again. Well, my being an "older" lady who resided alone with no eye witnesses and them with 2 teenaged boys the wife the grandmother & grandfather, who do you think they were going to believe? So, I took out my camera and filmed the entire thing even the part when he noticed me standing there with camera in hand shaking and proceeded to threaten to shove my camera where the sun doesn't shine( he used more crass words than that but well I'm not about to repeat them)all of which I got on camera, oh and my camera also has a little mic which captured everything he said.
So, after having recorded what I needed I call the fire station agai and reported them again, however, by the time the firemen made it here the tenant had already had the time to move the bbq to the other side of the driveway. I showed the firemen the tape just so they knew I wasn't fibbing. After that things were quiet for a while up until tonight.
You see we have a very strange drivewy which has 3 three entrances, one of which, you guessed it, goes right by my kitchen windows and the fire escape stairs. Well, now the other tenant has taken a couple of LARGE tarps blocked off a part of the one side of the drive way by attatching it to some trees/branches and the second one to some more trees but also to parts of the house as well whichblocks my kitchen window from any dylight I used to get from that side. On top of that, I went to walk my dog tonight and she like to go around that side of the driveway to start for her wal, well, I forgot almost all about the tarps up until it was to late and almost choked myself & fell flat on my face by being tripped by the cords he used to attach the thing to the house. Now , I have also just about finished recouperating from a very serious operation of which has taken me up till now 6 six weeks to recover, however I have been having some problems with healing and have booked an appointment with the doctor for a follow uo (2nd) one. I am tired of the constant battle with these people and YES, I am STILL looking for another place to move to even if I have to change towns/cities whatever.
I have tried looking on line to find out what the City By-Laws are concerning such matters but have gotten no where.I've also told the landlord. Oh and get this, you know one of those little tent like things you can put up on your lawn that has no sides to it? Well, he has even BOLTED one of those into the driveway close to where he put up the tarps.
Does anyone out there know what legal stands I can take? Or even what the By-Laws would be in such cases in the town of Lindsay (City Of Kawartha Lakes) Ontario Ccanada? Or even a link directing me exactly to the information I need?Please?
