My sons bio dad has been out of the picture since he was two and now he is twelve... I recently got the chance to speak with bio dad and he is mentally ill now... he collects social security disability... it took me a few weeks to think about it and I went and filed for my son to collect off him... I brought in paternity papers and all needed court documents.. . the ss lady said she had to pull his application and see if he listed him as a dependent... so that took 24 hours to come back and she called today and told me that he did put my son on the application. And she asked me for a bank account for my son... I had mentioned to her yesterday that if my son did get anything that I would open him a savings for college account... so when she called today she wanted me to call her back after I opened an account... I just left her a message with the account number... she seemed pretty excited that he listed him on the application... she said she had not calculated anything yet but I did ask her if my son was eligible for back pay... she said she hadn't calculated anything yet... what does this all mean... hie bio dad did not keep s bio dad was not keeping his sons money in case that is a queation you may have... its just been sitting there... if it is approved and my son can get back pay... it is a lot of college money... I don't want to make a mistake... should I get an attorney so I can truly tell how long bio dad has been getting ssdi? Will ss pay him the right amount or do I need to be wary of this... I worked so hard to provide for him all alone and we are good and have no debt... I just want him to have all that he deserves... every cent... I am pretty nieve about this stuff... also he hasn't paid child suppt in ten yrs. What does this do woth that?

I would be very much ontop of this. If a lawyer is what you feel is best then do it! I know plenty of people who have had to get lawyers later when they realize the social security dept had made mistakes and would not change them easily

There may be some discrepancy in how far back your son can get his benefits. It may be determined that he is only eligible from the time you applied or it may be determined from the time the dad put him in as a dependent. The lady at the SS office should be able to give you a clear answer as to from what date your son will be eligible to collect his benefits.
