View Full Version : What rights does a 16-yr-old have to live with the other parent?

When my husband and I separated he was given full custody of out children due to circumstances at the time. My daughter is now 16 and having many problems at home causing her problems in the home and at school. This is leading to depression and other health issues.

She wants to get away from the drama and chaos in her life and start fresh by moving to live with me (in a different province than her father). I am more than willing and capable of supporting her. I want to do what is best for her and to get her back in school and back on track with her happy life.

What rights does she have to choose where she wants to live?

Destiny, what province do you live in ? Only asking because it determines an answer as to age your daughter can make her own decisions.

I live in New Brunswick.. she is in Ontario

She has the right to express her preference, that's all. She cannot make the decision on her own. YOU have to file a petition in Ontario for the change in custody. She will be allowed to express her preference to the court. But the court will make the decision based on what it deems the best interests of the child.
