View Full Version : I was hit by a car, I have no license and the insurance is under my mom.

Hi guys, so last night I was driving home on the freeway and I was going 55 mph (construction zone, 2 lane road). I looked in my rear view and I see this car pass up two cars behind incredibly fast by the time driver passed them up the person had already lost control of the car and she rear ended me going 90 mph, I am OK aside from some really nasty whiplash but the other driver was beat up and taken to the hospital in an ambulance. So I was obviously not at fault here but I have no license and I was driving my mom's car. My mom does have insurance but I'm not under the insurance and I'm kind of scared as to what will happen. I'm pretty sure her insurance should cover it all but can anybody just give me their 2 cents.

First be sure to go to the doctor and have your neck and back checked, what is just sore the morning after can end up with you not being able to move in a couple days. High speed rear end causing neck injuries can be very serious.

Next I will assume you got a ticket for driving without a license, you will have to pay a fine and most likely not have a period you can not get a license.

How old are you ? Do you live at home with mom ?
Insurance is normally on the car, not the driver, you would be insured to drive my car if I gave you permission.

But if your mom knew you did not have a license, and allowed you to drive, her insurance may also refuse to pay anything.

But your moms insurance should not have to pay anything, your mom needs to file a claim against the other driver and their insurance.

The real problem will happen if the other driver did not have insurance.
