If my father who is 89 years old in the hospital and in poor health, passes, God Forbid. Will I be liable for his credit card debts? Live in NB, Canada.

Unless you are joint card holders, no. His estate, however, will be responsible. If he has no estate, then they go unpaid.

When he passes an executor will be appointed for his estate. If there is insufficient assets to process, simply make copies of the death certificate and send them to any creditor with a statement that he died with no assets.

If they continue to send bills, return them UNOPENED marked DECEASED.

Thank you very much. Hope you don't mind if I ask more questions. If the house is willed to my Mom and then to me. What will happen then. Oh, I Have Power of Attorney for both of them.

If the house is left to his spouse in a will, then it becomes part of the estate. The estate would then have value that could be used to pay off the debts. So the creditors might force the sale.

If the house is willed to his spouse, then it would be up to the spouse to will it to you. The spouse can then do with it what they want.
