View Full Version : Is my landlord breaking laws if I do not have a copy of my lease?

When we rented our house we were going to rent both house and a flat at the back, the land lady said she wanted to move into the flat at the back for a month or so, he is now living there full time, we are very unhappy, she has made up rules for my children and dogs, put up a fence to give her more space restricting my space, taken away my use of the garrage space. Not fix things in the property she said she would fix. I gave her notice on 8th oct as we wher working on a month to month basis since she moved into the back flat, are we within our rights to move out at end oct?

ANY question on law needs to include your general locale as laws vary by area. So we can't tell you if any laws were broken without knowing where you are.
But if you are on a month to month rental. You can generally give a 30 day notice and then move. Some areas require a calendar month notice which could mean you will owe rent for November. It may depend on when rent is due. Or, if you properly documented the grievances, you may not have a problem.

We are in south africa, I am unsure of what my contract said because she has not given me a copy? We were meant to be renting for a period of 6 month, but we were uder the inpression that she was going to move to the back flat for a month, then move as we were going to rent out the flat and help us with the rental. When we firt moved there, we had to put in a pool net, she said she would use this as part of our deposit, she now is making us take the pool net and not pay towards it, she has then put up a fence which has giving me a meter and half space in my back yard instead of 12 meters. There are verious other thing, for example, she was meant to fix certin things in the house these have not been done. I am pulling my hair out, I now have received a long email from her stating things that are wrong, for example my dogs have damaged the grass because they only have one area to run in, because of a fence going up. Yet she is going to take money off the deposit for the damage to the grass.
