View Full Version : Florida law, kicking adult children out of our house?

My Husband and I have a 26 year old son, that is a felon 3 times over, the last one for stealing my mother's diamond ring from me. He got out in April 2011. He had no place to go so we let him come home with a lot of reservations. He does not have a key and cannot stay in the house when we are not there, which was all verbal. We went on vacation in August and he broke into our back door which we had boobie trapped. When he realized it he called us and told us what he did. We gave him till first of sept to move. He hasn't. He also in the past has come through windows. We just found out that he took the back door off the hinges to get in. And the door and the frame are damaged. We told him to get out. Under the circumstances do we have to follow legal courses or should we just call the police to have him removed?

You have to have him legally evicted. That means have him served papers giving him 30 days to vacate. He is by all legal statutes a Tenant and has the same rights and protections.

However if he is doing all that damage, the police might remove him... but do fiollow through with the eviction just the same to keep him from returning.

After that it would legally be breaking and entering.

You might want to consider a restraining order as well to increase the penalties if he does try again.
