View Full Version : How can I sue my boyfriend for ilegally evicting me?

I have been living with my boyfriend for almost three years. He has been paying the rent and all the bills. He his been supporting me because I don't work, but I am studying and I finish in October this year. Now we broke up and he wants me to move out knowing I have nowhere to go and that I don't have a job yet. What can I do legally about this?

Nothing you can do... but get a job and get an apartment or another room mate, or move back in with mom and dad.

All he has to do is legally evict you and you can't do anything. And he can do that in just 30 days notice. He has no legal obligation to continue to support you. The key word being Boyfriend... not Husband.

You need to read up on the laws, because its NOT illegal to evict you legally (following legally mandated written notice) or stop supporting you without warning. Sorry that's not what you hope to hear, but that's the reality of things.

Possibly. But he has not illegally evicted you yet. And, as others have indicated, he has every right to legally evict you.

What state are you in, laws vary from state to state so he must follow your states eviction laws. Landlord.com Eviction Notice Termination Law Guide By State (http://www.landlord.com/eviction-notice-termination-law-guide.htm) BTW, no you can not sue him unless he boots you out and does not follow the law.

You cannot sue him if he follows your state's laws regarding notification and eviction laws. If he does not follow those laws, yes, you can sue him.

First, are you signed on the lease or does he own the property? Second, which is it did he illegally evict you or do you just think that asking you to leave is an illegal eviction.

As noted, if he is the owner or leaseholder he has every right to ask you to vacate. He has to give you written notice of the correct length (which would depend on local laws). Note: ANY question on law needs to include your general locale as laws vary by area.

If you refuse to leave then he has to go to court for an eviction order. What he can't do is change the locks on your or throw your things out.

Thanks for all the help... I just wanted to know how long do I have before I have to move out? I am in Puerto Rico and I don't know what the law here is. Can someone help me out and fill me in? Thanks!

He would have to give you 30 days notice.
