My son has his daughter because his daughter who is 10 told my sons g/f that her moms b/f tied her to a chair and force fed her so my son took her to police station and they gave him the number for cps called cps in pa that is where he lives his ex wife lives in Ohio my son got a summons to return her what can we do to keep her safe and away from the abuser be the way she is 10

Presumably CPS investigated and found that there wasn't proof of abuse, so he must abide by the summons ASAP and be vigilant in the future. Of course the system makes mistakes in both directions, letting abuse happen and taking unabused children away, but they do the best they can with limited resources and time.

He can get a lawyer. He can talk to Family Court to learn more about forms and procedure, or a legal clinic or law school. He can look at his state online .gov site. But he can't take the law into his own hands.

Where did he get the summons from? Has PA CPS finished their investigation? These are key pieces of info we need to know to give advice.

But your son can't defy a court order, unless he gets a court to reverse it. Which means if he has an order to return the child, then he either has to return her or IMMEDIATELY file for a stay of the order. The only way he will get the stay is if CPS has not completed their investigation. So his grounds for asking for the stay would be for CPS to complete the investigation.

If he does have to return the child, then he needs to instruct the child to immediately report any further abuse. She should report it to her school guidance counselor if any such thing happens again. But you also need to make sure its real abuse. She shouldn't just report something because mommy is being too strict etc.
