Can I sue the man that burgled me he hasn't been found guilty at this moment but considering the theiving little bastard never had the brains to not leave fingerprints and wait for people to be out before him and his gang of 6 other chicken ****e mates stormed in threating us with slabs of concrete and throwing bricks we also managed to identify him

Sure you can sue him but it will go better in court if he is convicted of the burglary of your home. Sue all of them if you know their names.
Aren't they all in jail waiting for trial? Sounds more like a home invasion going on there than a mere burglary.

It is an aggravated burglary and they only caught this one because of the fingerprints still been on record has he was on a probation order before this, he is in custody now and already been in front of a judge once but doesn't go to court till October but he is been remanded in custody until then. They did it to a few more people in the same area but they are all too afraid to testify

Yes, you can even sue him if he is not convicted. Look at the OJ trial here in the US. He was found not guilty of Murder but the civil court found him responsible.
So yes you can sue him.

Yes you can sue him, but since this appears to be a career criminal who is going back to jail, what do you think you will collect? Suing someone and collecting a judgment are very different issues.
