Helloall.. ivecomeacrosswhsat lookslike quite a few informed / knowledgeable repliestothetopics I've seen on this site. So I feel quasi comfortable about the responses I will receive... I am a single mom been employeed with same company for 19years and am proud of the home I have been able to provide for all my 3 kids(I own NOT rent. the 2 oldest 39 & 25 both grew up moved out at 18(on good terms) and are well on their way to being productive adults...
Now the reason I'm seekin you're help, is my youngest(just turned 20 a few months ago(has not looked for a job(let alone had 1 in past 18months... Stays out all night comes home and goes to sleep just bfore I get up 2 gotowrk.. sleeps 95% of the 10+hrs I may put in daily... gets up before I get home makes a mess by eatin/watchin TV .bla blah blahand leaves 30 minutes before I get home etc.etc.etc. Short story long...
Do I have to fill out the ud100 only, for eviction even thou its not a tenant/landlord dispute?
And 1(b) is there a way to expedite it giving the situation, or will the 30 days be standard protocol... Tyall so very much

There is no "easy, short way" legally to handle this situation. You need to follow the legal eviction procedures to get him out.

Although it doesn't LOOK like it, it IS a landlord/tenant dispute in terms of the law.

I got a lazy disrespectful 20 yr old son I need to evict from my hse... is it still just ud100 even thou its mom/son not lndlord/tenant?

In the USA it doesn't matter... if they have no written lease its legally month to month... then all you have to do is have them legally served to vacate in 30 days in writing. Don't do it verbally... you want a proper paper trail, signatures etc..

Family or non-family... the process and procedures are the same.

Does he have a cellphone? Does he drive a car that you pay for? Have you tried cutting off the luxuries of his life? If you have cable and internet at home consider dropping them for a short period. Give him a wake up call. 20 is too old to be lounging around the house sponging off mom.

This may be a silly question but... did you actually confront him about this and tell him that he needs to grow up? Maybe you are being too easy on him.

1st off THANK YOU ALL for the rapid informed responses... now my only (I hope) other resources I'm looking to find... I've read that u want to completely fill out all court forms... theres a lot there that doesn't pertain to this case... e.g.. Written/or verbal contract... / amount of rent due/ at time of filing $X.XX is owed/// do i8 really leave each 1 blank that isn't relavent or doesn't have an (other) coloum

and if my research is wrong... proof of service is recommended but not required by ca law and

and I'm not looking to have someone fill **** out for me or receive hand outs... but is there a site/book/anything that will explain what info is needed on each line (in lamens) terms...


@ odin I've told him he's not welcome in my house as long as he isn't lifting a finger to contribute anything to the household(from giving me cash or doing the friggin dishes, cleaning up after the dogs, sweepin the floor etc etc... I'm lucky if I don't get a string of F^&K yous , get off my F*^%IN case lbla bla... and absoluytely refuses to leave...

Ok, I kind of figured it was like that but I thought I would ask. I know some people don't bother with the obvious, you know?

There is a place out of Berkeley California called nolo press. They have books on law for the people. You might want to check there.
