I am a native born U.S. Citizen.
My wife is Chinese but we were married by the court in 2003 in Bayonne, New Jersey and in 2005 she received her Permanent U.S. Resident Card. I want to revoke my wife's green card because I have found out that she lied to me. She married under her maiden name of Ma Ning but her real name is Ma Yan. She used a fake Chinese birth certificate as proof to get the marriage license in 2003. She also holds a Chinese government passport which is presently valid because her father is Chinese citizen and he was a Chinese government worker.

Is there a way to use this a proof as immigration fraud to report to the USCIS so that they can revoke her green card?

I don't think what you outline is an immigration issue. You can't have her green card removed on the suposition that she lied to you. There is nothing to prove that she committed any kind of fraud.

edit: Why do you think it is unusual that she holds a valid chinese passport? You say 'government passport'; passports are issued by the government in any country.

For one thing, there are various practices of name order and name change in China that are quite involved and nothing like the 3 options Americans use (keep maiden name, adopt husband's name, hyphenate both names). So how do you know that she 'lied' and that her BC is fake? What does the passport have to do with it? And her father? It sounds to me like you just want out of the marriage. Get a divorce. Or contact the CIA, maybe she's a deep cover spy.

In China there are two types of passports one type that ordinary citizens get usually or an official government passport because it is a deep burgandy color and the passport number starts with "G" in front of the number. You can only get this if your family or yourself have been working or connected to the government of China.

Secondly, I saw here original Chinese I.D. and original birth certificate with the name MaYan and all of her family knows her by this name not MaNing. One of my Chinese fiends who is close to her as a friend knows she used a fake birth certificate from China because it is very easy to do that there.

Yes I am aware of what you have mentioned above about the names because I have lived in China for sometime before.

Yes, I will be honest I want out of my marriage because I thought everything she said was true but just lies to get a green card. I know that is my fault not much I can do about that now but I do not want her to have the pleasure of being an American resident when all she does is talk bad about my country and that the only thing good is the dollar for now.

Tony, you still have to PROVE immigration fraud to have her green card revoked and her deported. There are numbers to call for each state (you don't say which one you are in); these can be found on Google.

You have talked 3 times about her passport but not what it has to do with her lies. When was it issued and when does it expire, and what does it mean to you? Have you asked her why she got here under a different name? To tell you the truth, it sounds like you two rarely communicated about anything during 8 years. It seems cold to me to want to get her in trouble just because she went by an old name to get here. Even if that's what allowed her to get here, do you really want her deported over that? If she badmouths the US, maybe she's just plain unhappy in her marriage. You two need help, I think. But if you just want out just divorce her.

No, this is not enough to be a issue to immigration. And under many of the current guide lines, not even enough for them to look into
